  • The Autostrada A1 ( Polish for 'Motorway A1'), also called Autostrada Bursztynowa (Polish for 'Amber Motorway'), is a predominantly completed, partly under construction motorway in Poland . The 565 km long route leads along state road 1 from north to south. It begins near Gdansk and leads via Toruń to the Łódź Północ motorway junction , where it crosses the A2 motorway . In the further course it leads via Częstochowa and Gliwice to the border with the Czech Republic at Wodzisław Śląski . At the Gliwice-Sośnica motorway junction, it crosses the A4 motorway . At the Czech border it turns into Dálnice 1 .

    The motorway is part of the pan-European traffic corridor  VI and the European route 75 between the two motorway junctions Rusocin and Pyrzowice .

    Planning history

    Already in the network plans of 1945 and 1946 a connection from Tricity to the Czech border is planned. The route is consistently included in the network plans from 1963, 1971, 1976 and 1985 in different variants. In the 1993 network plan, the route is referred to as A1. Since then, it has been in the plans as A1 throughout. In 1972 planning for the route from Tuszyn via Piotrków Trybunalski to Częstochowa was started. The plans envisaged that the new road would bypass all localities and be expanded like a motorway . The road cross-section should consist of two lanes, each with two lanes. At the end of the 1980s, the entire route was opened. However, only the 17.5 km long route to Piotrków Trybunalski was referred to as a motorway. The rest of the route was signposted as Landesstraße 1 , as the originally planned nodes were realized as crossings with traffic lights . In 2005, the Toruń bypass was opened and named the S10 expressway . After the completion of the A1, the A1 and the S10 will run together on this 10.5 km long route.

    Passenger cars

    The 150 km long section from Gdansk to Toruń is a public-private partnership . As a private contractor that was motorway operator company Gdańsk Transport Company is committed which is responsible for the financing, design, construction and operation of this section of the highway. Therefore, toll fees are charged at the toll stations on this section.

    The state authority GDDKiA is responsible for the next section of the motorway from Toruń to the Tuszyn junction . This will only become a toll after the completion of the sections from Toruń to Kowal and between the nodes Łódź Północ and Tuszyn. Although the toll for the section between Toruń and the Łódź Północ junction could be independent of the status of the section between the Łódź Północ and Tuszyn junction, a toll station would have to be created near the Łódź Północ junction. The current plans include the introduction of the toll after the entire completion of the section together with the sections of the A2 motorway between the Konin Zachód and Pruszków junctions . This closed system would be limited to the north by the Nowa Wieś toll booth near Toruń , to the south by the Jeżów toll booth near Piotrków Trybunalski , to the west by the Żdżary toll booth near Konin on the A2 and to the east by the Pruszków toll booth near Warsaw on the A2.

    The introduction of tolls for the next section from Tuszyn to Pyrzowice depends on the decision on the implementation model. If the section were to be implemented as a public-private partnership, two additional toll booths would have to be built at both ends of the section. Regardless of the decision, this section will also be subject to tolls.

    The toll requirement for the motorway section in the Silesian Voivodeship from Pyrzowice to the Czech border, which was decided by the Polish government in the planning, is controversial due to the population density in the metropolitan region of Katowice - Upper Silesia . The section from the Gliwice Wschód junction to the Gliwice-Sośnica motorway junction is intended to be toll-free as a bypass of Gliwice only for the population of the region. The remainder of the A1 was originally intended to be tolled for everyone. The residents of the towns of Rybnik , Jastrzębie-Zdrój , Żory , Wodzisław Śląski , Racibórz , Rydułtowy , Radlin and Pszów , who demand the two sections of the Gliwice-Sośnica-Gorzyczki motorway junction and Bytom-Pyrzowice as toll-free, are opposed to this decision .

    Trucks

    The viaTOLL system is currently used for trucks on most of the motorway sections operated and completed by the GDDKiA . On the other hand, the trucks on the section operated by Gdańsk Transport Company have to pay the toll manually at the toll stations.

    This section has been divided into two parts:

    On 29 July 2005 began concessionaire of this section, the motorway operator company Gdańsk Transport Company , the construction of the northern section between nodes Rusocin in Gdansk and Swarozyn at Tczew . This 25-kilometer section was opened to traffic on December 22, 2007. The second section between the Swarożyn and Nowe Marzy junctions was handed over to traffic on October 17, 2008. The entire section has a total length of 89.5 kilometers and has two lanes with two lanes each and the possibility of adding a third lane. A route toll is levied on the entire section at the toll stations at the beginning or at the end as well as at the exits .

    On 25 August 2008, began concessionaire of this section, the motorway operator company Gdańsk Transport Company , officially the construction of this highway section from the node Nowe Marzy in Grudziądz to the node Toruń Południe (formerly "node Czerniewice"). The entire section has a total length of 62.4 kilometers. The construction comprised a 51.72 km long, after completion, toll road between the Nowe Marzy and Toruń Wschód junctions. Between the Toruń Wschód and Toruń Południe junctions, the existing 10.7 km stretch of the S10 expressway was upgraded to a motorway by adding a second lane . This means that the section with two lanes with two lanes each is expanded. The modernization of the existing line and the construction have about 4.64 billion zlotys cost. The traffic handover was initially expected by the end of 2011. The section was officially opened on October 14, 2011. Shortly before the handover, it was announced that drivers would not have to pay any tolls for the first three months. On December 29, 2011, the postponement of the toll obligation for another month was announced. On February 11, 2012, around four months after the opening, tolls were introduced on the entire Nowe Marzy − Toruń section.

    Toruń Południe - Włocławek Północ

    This 34.5 km long section leads from the Toruń Południe junction (formerly “Czerniewice junction”) to the Włocławek Północ junction. It is expanded with two lanes, each with two lanes and the possibility of adding a third lane. On the part of the Polish government, the section should be subject to tolls for all motor vehicles .

    First contract

    In order to enable a faster implementation, the complete section has been divided into two subsections:

    The tender for these two subsections began at the end of March 2009 and was signed on June 17, 2010 with the signing of the contract between GDDKiA and a consortium consisting of the Irish company SRB Civil Engineering Limited as leader and the Polish group of companies PBG SA, Hydrobudowa SA, Aprivia SA and the Irish construction company John Sisk and Son ended as partners. The construction costs were set at 934 million zlotys . Construction began on July 16, 2010 with the symbolic groundbreaking ceremony. The completion of both subsections was originally planned for September 2012. On June 16, 2011, problems became known that could delay construction by as much as three months. However, this was denied by the GDDKiA with the statement that all construction work would proceed according to plan. In the spring of 2012, a construction delay of two months was confirmed, so that the construction work should initially be extended until November 2012. However, the companies PBG SA, Hydrobudowa SA and Aprivia SA filed for bankruptcy in early June 2012 and left the consortium. During this time, the company SRB Civil Engineering Limited continued the construction work. The Irish company announced at the beginning of July that it would continue the construction work as part of the consortium alone with John Sisk and Son from August and that it would take over the construction work in connection with the road surface immediately. In order to speed up the construction work, the GDDKiA gave the Irish construction companies on August 14, 2012 a one-week ultimatum to quickly carry out the most urgent work. After not all construction work could be carried out due to the fact that there was no final agreement with the Polish companies after the bankruptcy and their banks, the GDDKiA extended the ultimatum for another week.

    Second contract

    The renewed tender for the continuation of the construction work began on September 28, 2012. Approx. 40% of all construction work still needs to be done. The offers were opened on December 27, 2012. The cheapest offer was made by an Italian-Polish consortium led by the construction company Salini Polska Sp. Z oo and the construction companies Impregilo SpA and Kobylarnia SA as partners with construction costs of 450 million zloty . A consortium headed by Strabag Sp. Z oo appealed against this decision to the National Board of Appeal (Polish: "Krajowa Izba Odwoławcza") in Warsaw and succeeded in repeating the selection and correcting the incorrect offer made by the Italian-Polish consortium had to be. On March 15, 2013, the offer of the Italian-Polish consortium was again selected as the cheapest. After examination by the Public Procurement Office (Polish: "Urząd Zamówień Publicznych"), the contract was signed on April 3, 2013. The section was completed by the end of 2013 and opened on December 21, 2013.

    Włocławek Północ - Kowal

    This 29.5 km section runs from the Włocławek Północ node to the Kowal node . It is expanded with two lanes, each with two lanes and the possibility of adding a third lane. On the part of the Polish government, the section should be subject to tolls for all motor vehicles .

    First contract

    The tender began at the end of March 2009 and was approved on June 17, 2010 with the signing of the contract between GDDKiA and a consortium consisting of the Polish group PBG SA as leader and the Polish companies Hydrobudowa SA, Aprivia SA and the Irish construction companies SRB Civil Engineering Limited and John Sisk and Son ended as partners. The construction costs were set at 857 million zlotys . Construction began on July 16, 2010 with the symbolic groundbreaking ceremony. At the beginning of June 2012, the companies PBG SA, Hydrobudowa SA and Aprivia SA filed for bankruptcy and left the consortium. During this time there was no more construction work on this section. The Irish company announced at the beginning of July that it would continue the construction work alone with John Sisk and Son from August. Discussions would have to take place with those responsible at PBG and the GDDKiA about a new division of the construction work within the consortium. On August 14, 2012, the GDDKiA gave Irish construction companies a one-week ultimatum to quickly carry out the most urgent work. The GDDKiA extended the ultimatum for another week after no construction work could be carried out due to the fact that there was no final agreement with the people responsible for the Polish companies after the bankruptcy and their banks.

    Termination of contract

    Second contract

    Kowal - Łódź Północ

    This 75.2 km long section leads from the Kowal junction to the Łódź Północ junction and has two lanes with two lanes each and the possibility of adding a third lane. According to the Polish government, the section should be subject to tolls for all motor vehicles . In order to enable faster implementation, the entire section was divided into four subsections, which were originally supposed to be built by different construction companies by April 2012. However, construction delays occurred in all sections, so that completion was postponed by a few months. Although three of the four subsections were completed in July 2012, an early opening was waived because all subsections should be opened together. The traffic handover took place with a delay of a total of 197 days on November 13th.

    • Kowal junction - Kutno Północ junction (30 km)

    The construction contract for this subsection was signed on July 9, 2010 between the GDDKiA and the consortium , which was led by the construction company SRB Civil Engineering Ltd from Ireland and the companies John Sisk & Son Ltd (Ireland), Roadbridge (Ireland) and Budbaum SA (Poland) existed, signed. The construction costs amounted to around 800 million zlotys. At the end of March, Budbaum SA filed for bankruptcy and thus left the consortium. The Irish construction companies have since continued the construction work alone. After the announced end of the construction work, disputes arose between the GDDKiA and the Irish construction companies. The GDDKiA refused to pay a due remuneration in the amount of 47 million zlotys, which on the part of the construction companies violated the contractual terms and was contested in court. The GDDKiA should sign an additional agreement with the Irish consortium that would allow the GDDKiA to make payments directly to the subcontractors, as the Irish construction companies' arrears on payments to subcontractors amounted to PLN 18 million. All legal proceedings were concluded at the end of 2017 following a mutual settlement.

    • Kutno Północ junction - Kutno Wschód junction (15.2 km)

    The construction contract for this subsection was signed on June 18, 2010. The consortium led by the Polish joint-stock company Poldim SA and still consisting of the Czech construction company Bogl a Krysl ks was selected by the GDDKiA . The construction costs amounted to around 542 million zlotys. In this section, the construction company Poldim SA also had financial problems, so that an application for insolvency had to be filed at the beginning of April 2012 because there were debts to the value of 120 million zlotys with various banks. Due to this bankruptcy petition, part of the construction work carried out by this construction company was canceled. After months of limited construction work and discussions between the GDDKiA and the company Bogl a Krysl ks to take over the interrupted construction work as part of the consortium, an agreement was announced on July 26, 2012 so that part of this construction work could be continued. Construction work was accelerated in September and October so that most of the subsection could be completed in November. The Kutno Wschód motorway junction, two motorway service stations and the rest of the construction work, however, were removed from the construction contract and implemented in a separate construction contract. This was closed on April 23, 2014 between GDDKiA and the construction company Budimex with construction costs of 61 million zloty . All construction work was carried out in 13 months (excluding the winter months) by the end of July 2015. The node opened on June 25, 2015.

    The construction contract for this subsection was signed on July 9, 2010 between the GDDKiA and the consortium consisting of the construction companies Sando Budownictwo Polska Sp. Oo and Construcciones Sanchez Dominguez-Sando SA. The construction costs amounted to about 512 million zlotys.

    The construction contract for this subsection was signed on June 18, 2010. The consortium led by the German construction company Johann Bunte was selected by the GDDKiA . The consortium also includes the companies Bunte Polska Sp. Z oo, Mosty-Łódź SA, Erbedim Sp. Z oo and Intercor Sp. Z oo as partners. The construction costs were set at almost 570 million zlotys.

    Łódź Północ

    The 4.9 km long section of the A1 was built as part of the motorway junction. Part of the section was opened on June 3, 2012 with the commissioning of a further section in the direction of Warsaw on the A2 motorway . The second part will open with the commissioning of the A1 towards Tuszyn .

    Łódź Północ - Tuszyn

    This almost 40 km long section leads from the Łódź Północ junction to the Tuszyn junction and will have two lanes with two lanes each and the possibility of adding a third lane. This section should also be subject to tolls for all vehicles .

    First contract

    Finally, on December 22nd, 2010 another contract for the planning and construction of this subsection was signed. This time the GDDKiA selected a consortium led by the joint stock company Polimex-Mostostal SA and consisting of the companies MSF Engenharia SA, MSF Polska Sp. Z oo, Doprastav as and Mostmar SA. The investment costs amounted to approximately 1.159 billion zlotys. Construction should start after the end of the planning phase at the end of 2011. However, changes had to be made to the planning documents, so that the three building permits were only issued in mid-August 2012 and granted by mid-January 2013. Thus, the handover could not be complied with at the end of 2013. At the end of September 2012, the completion date was extended by 9.5 months to the end of June 2014. In mid-2013, there were major construction delays because the consortium could not agree on the terms of the contract with the subcontractor Strabag, who was involved in the construction of all bridge construction work . Strabag then withdrew. The search for new subcontractors turned out to be difficult due to the financially strained situation of the consortium and only ended in November 2013 with the signing of contracts with the construction companies Himmel i Papesch Opole Sp. Z oo, Warbud SA and Mota-Engil Central Europe SA. In the contracts it was agreed that the completed construction work would be paid for directly by the GDDKiA. Completion was planned for the end of 2014.

    Termination of contract

    On January 14, 2014, the construction contract between the consortium led by Polimex-Mostostal SA and the GDDKiA was terminated prematurely. In addition, all contracts with the subcontractors were terminated. After the termination of the contract, subcontractors submitted numerous requests for financial arrears to the GDDKiA. These amounted to over 50 million zlotys. The subcontractors also made financial claims against the general contractor. With regard to the question of guilt and the reasons for the termination of the contract, there were legal proceedings. According to the GDDKiA, the major construction delays were the main reason for the termination of the contract. Up to 10% of all construction work was completed in 2013, with half of the construction work originally supposed to be completed by the end of 2013. On the part of the construction company Polimex-Mostostal, the GDDKiA was accused of failing to submit the legal payment security for construction work within the prescribed period, of violating essential contractual provisions, which consisted in the rejection of legitimate claims by consortia, and of delaying the payment of wages. Thus, the company has a right to claims for damages in the amount of 475 million zlotys for the terminated construction contracts on both the A1 and A4 (Rzeszów – Jarosław) and S1 (Bielsko-Biała – Żywiec) . The GDDKiA refused the payment. The start of negotiations regarding a possible agreement was announced in court at the end of May 2017. The total value in dispute is 507.5 million zloty on the part of the consortium and 503.9 million zloty on the part of the GDDKiA.

    Second contracts

    On February 7, 2014, the second invitation to tender started to make changes to the planning documents and to continue the construction work. The section has been broken down into three subsections to allow for faster implementation. The contract for the first subsection between the nodes Łódź Północ and Łódź Wschód (14.2 km) was signed on October 3rd with a consortium of Strabag and Budimex worth 340 million złoty (approx. 85 million euros). The contract for the third subsection between the nodes Łódź Górna and Tuszyn (15.9 km) with construction costs of 327 million zlotys (approx. 82 million euros) was signed with this consortium on September 30th. For the middle subsection between the nodes Łódź Wschód and Łódź Górna (10.0 km), the contract was signed with Mota-Engil on October 6, with an order volume worth 361 million złoty (approx. 90 million euros). A construction period of 22 months was specified in all three contracts, with completion scheduled for July / August 2016. The construction work was accelerated to such an extent that the entire section of the motorway was officially opened on July 1, 2016, thus closing a gap in the central Poland motorway network. Now all long-distance traffic can be routed out of the urban area of Łódź , which relieves traffic in Łódź itself and the neighboring communities. In addition, the travel time on the north-south axis is shortened by 1.5 to 2.5 hours, depending on the time of day.

    Pyrzowice - Piekary Śląskie

    In September 2005 it was decided to localize this section of the A1. It runs from the Pyrzowice junction to the Piekary Śląskie junction . The contract between the GDDKiA and the construction companies Budimex and Mostostal Warszawa was signed on July 27, 2009 for the construction of this 16.1 km long motorway . A construction period of 23 months was agreed, which officially began on August 20, 2009. Completion was scheduled for April 20, 2012. However, there were construction delays, so that the handover had to be postponed by almost two months. The completion of the section took place on May 8th, the traffic handover on June 1st, 2012. The construction costs amounted to 1.83 billion złoty . This section is expanded with two lanes, each with two lanes and the possibility of adding a third lane. On the part of the Polish government, the section is to remain toll for all vehicles .

    Piekary Śląskie - Gliwice Wschód

    In October 2005 it was decided to localize this section of the A1. This section runs from the Piekary Śląskie junction to the Gliwice Wschód junction. The contract for the construction of this 20.1 km long motorway section was signed on June 16, 2009. The company Dragados was hired as a construction company . A construction period of 23 months was agreed, which officially began on July 8, 2009. The completion and handover was originally agreed for December 8, 2011. However, the floods in Central Europe in 2010 led to construction delays, so that completion had to be postponed to 2012. However, it was possible to complete an 8.1 km long motorway section between the Zabrze Północ and Gliwice Wschód nodes and to open it on December 22, 2011. The traffic transfer of the remaining part from the Zabrze Północ junction to the Piekary Śląskie junction took place on June 1, 2012. However, the construction work continued until October 2012. The Bytom node opened on October 16.

    The construction costs amounted to 1.26 billion złoty . The 8.1 km long section between the Zabrze Północ and Gliwice Wschód junctions has two lanes with three lanes each. The remaining 12 km stretch from the Zabrze Północ junction to the Piekary Śląskie junction has two lanes with two lanes each and the possibility of adding a third lane. On the part of the Polish government, the section should remain toll-free for passenger vehicles.

    Gliwice Wschód - Gliwice Sośnica

    In October 2005 it was decided to localize this section of the A1. This section runs from the Gliwice Wschód junction to the Gliwice-Sośnica junction . On March 9th, 2009 the contract for the third section between the GDDKiA and the construction companies Polimex-Mostostal , Doprastav and Eurovia Polska was signed. A 21-month construction period was agreed, which officially began on March 31, 2009 and, according to the plans, should end on June 31, 2011. However, due to the floods in Central Europe in 2010 there were construction delays so that the handover of traffic was postponed to September. On September 19, the construction work was officially declared finished. The traffic handover took place on September 30, 2011. The construction costs amounted to around 1.1 billion zloty . This section has two lanes with three lanes each and remains toll-free for cars .

    Gliwice Sośnica

    The 2.2 kilometer long section of the A1 was built as part of the motorway junction. The first part of the section was opened on December 23, 2009 with the commissioning of the section towards Rybnik . The second part opened at the same time as the traffic handover of the section towards Gliwice Wschód on September 30, 2011.

    Gliwice Sośnica - Rybnik

    In October 2005 it was decided to localize the entire route of the A1 in the Silesian Voivodeship . In January 2007, the contract between GDDKiA and the Greek construction company J&P Avax was signed. The construction of this section, which leads from the Gliwice-Sośnica junction to the Rybnik junction , began on March 26, 2007. All construction work was completed by the end of 2009, so that traffic could be handed over on December 22, 2009. 83% of all costs in the amount of around 827 million zlotys (approx. 250 million euros ) were borne by the European Union . The entire section has a total length of 15.4 kilometers and has two lanes with three lanes each. According to the Polish government, toll collection is planned on this section.

    Rybnik - Świerklany

    In October 2005 it was decided to localize the entire route of the A1 in the Silesian Voivodeship . This section runs from the Rybnik node to the Świerklany node . On August 7, 2008, the contract between GDDKiA and the construction companies Strabag and Heilit Woerner was signed. A 21 month long construction phase, which officially began on August 29, 2008, was decided. However, due to the floods in Central Europe in 2010 , construction delays occurred , so that the entire completion of the section was impossible by the end of 2010. For this reason, the first 7.5 km long section between the Rybnik and Żory nodes was released on December 15, 2010. The remaining construction work was extended until May 2011. On April 21, 2011, traffic was handed over to the second section between the Żory and Świerklany nodes with a length of approx. 7 km. Half of the construction costs of 1.1 billion zlotys for this section were borne by the European Union . The entire section has a total length of 14.5 kilometers and has two lanes each with three lanes from Rybnik to Żory and two lanes each from Żory to Świerklany . According to the Polish government, toll collection is planned on this section.

    Świerklany - Gorzyczki

    In October 2005 it was decided to localize the entire route of the A1 in the Silesian Voivodeship . This section leads from the Świerklany junction to the Polish- Czech border at Gorzyczki / Věřňovice. There the A1 will merge into Dálnice 1 . The entire section has a total length of 18.3 kilometers and has two lanes with two lanes each and the option of adding a third lane. According to the Polish government, toll collection is planned on this section.

    First contract

    The first contract between GDDKiA and the Austrian construction company Alpine Holding was signed on November 18, 2007. It provided for construction costs of 1.1 billion złoty and a construction period of 26 months, so that the construction work should be finished in January 2010. During the earthworks, bombs from the Second World War that had not been detonated were found, which a special company removed in 5.5 months. As a result, the construction work was delayed by seven months compared to the agreed schedule. In addition, in February 2009 the construction company expressed initial concerns about the correctness of the construction project for a bridge called “MA 532” near the Mszana junction . These concerns were confirmed by some experts in the construction industry with fears of a construction disaster due to the collapse of the bridge, so that documentation on the improvements to the bridge construction was handed over to the GDDKiA. The start of construction of the bridge was canceled. The GDDKiA rejected the improvements after consulting the designer, who did not detect any errors after reviewing the project.

    First contract termination

    On December 15, 2009, the contract concluded with the Alpine construction company was prematurely terminated by the GDDKiA . The reasons for this measure on the part of the GDDKiA were considerable construction backlogs of several months, since at the time of the contractually agreed construction progress of 85%, only half (50%) of all construction measures had been completed. The compensation to be paid by the construction company was set at PLN 160 million. On the part of Alpine, the fears expressed about the construction of the “MA 532” bridge, which the GDDKiA did not take into account, were another reason for the canceled contract. After the construction company did not comply with the GDDKiA's request to leave the construction site, the GDDKiA then filed a lawsuit with the Warsaw District Court, which in a judgment announced at the end of January 2010 awarded the GDDKiA the right to do so.

    Second contract

    After the repetition of the tender until mid-2010, the second contract for the continuation of the construction work was signed between GDDKiA and the again selected company Alpine Holding on October 1, 2010 . A stricter schedule and the extension of the construction work until April 2012 was set. Construction work officially resumed on October 15, 2010. The cost was around 555 million zlotys . In addition, the designer made some improvements to the construction project for the "MA 532" bridge. However, the latter had refused the complete change to the project, which the construction company had requested. Construction of the bridge began in mid-2011.

    During the construction of the bridge, there was damage on December 22, 2011 and March 13, 2012, which the construction company can attribute to the faulty project. The GDDKiA, on the other hand, said that the damage had nothing to do with the controversial project, but that it was caused by mistakes by the construction company. On April 12, 2012, the Silesian Voivodeship Inspector for Building Supervision stopped the construction of the bridge on the grounds that continuing the construction work without repairing the damage could bring the previously built object to collapse. In addition, no experts agreed to share the GDDKiA's point of view that no errors can be found in the project. The GDDKiA lodged an objection on the grounds that it, the designer, its building supervisor and an independent expert had not found any arguments for a construction freeze. The objection was rejected and a two-month inspection of the structure took place. The results were published on June 4, 2012: The construction work carried out so far would not allow a safer continuation of the construction work on the basis of the project and no future use of the property. In addition, the damage would have to be repaired and the bridge structure additionally stabilized. August 31, 2013 was given as the deadline for the end of the repairs.

    On the part of the GDDKiA, the construction company is responsible for this situation and must bear the costs incurred for the repairs itself. On the part of Alpine, the project and thus the GDDKiA are responsible for this situation. On July 23, 2012, the Alpine construction company agreed to carry out the necessary repairs and additional construction work and to bear the costs themselves. Thus, construction could continue according to a new schedule.

    Early opening of the Mszana - Gorzyczki (PL / CZ) node on November 30, 2012

    At the end of October 2012, the early opening of the 11.1 kilometer stretch from the Mszana node to the border with the Czech Republic near Gorzyczki was announced. The reasons are, on the one hand, that the entire section, except for the “MA 532” bridge, has been completed, and on the other hand, the Czech government has been pushing for the opening of its Dálnice 1 section, which was completed in April 2012 . For this reason, both sides agreed on a joint opening on November 30, 2012. However, the new motorway sections can only be used by cars , as traffic has to be guided in both directions on a connecting ramp at the Mszana node that is not restricted by the damaged bridge . A diversion has been set up between the Świerklany and Mszana nodes via the provincial  roads 932930 and  933 . For this purpose, the pavement of voivodship roads 930 and 933 was renewed by the Alpine construction company at their expense.

    Second contract termination

    On May 14, 2013 the construction company Alpine Bau announced the withdrawal from the contract for the "MA 532" bridge structure. The reason for this was the ongoing dispute with the GDDKiA about how to proceed with the construction of the bridge. According to Alpine, it is not possible to resolve the dispute. Although 95% of the structure has already been completed and a precise repair period has been set, according to the construction company completion is not possible due to inadequate statics and demolition is the solution advocated. In addition, GDDKiA had illegally accessed the bank guarantee of 55 million zloty (12 million euros) stipulated in the contract. In contrast to the position of the construction company, the GDDKiA is still of the opinion that the building can be completely completed by the end of 2013, if necessary with Alpine subcontractors alone. The construction company does not comply with its own declaration of July 2012. After the construction company did not reverse the decision, even at the request of the then General Director Lech Witecki, the bank guarantee was transferred to the GDDKiA account on May 24, 2013 and the bank granted the GDDKiA rights. On May 27, 2013, the GDDKiA announced the termination of the contract for the entire partial order of the section due to the fault of the construction company. Insolvency proceedings were initiated against the parent company in Vienna in June 2013. After an insolvency application for the Polish subsidiary was rejected by the commercial court due to a lack of funding for insolvency proceedings, this was initiated in early 2014. The debts amounted to about 50 million zlotys with 200 companies. Liability for disadvantaged subcontractors was regulated by the GDDKiA, which paid out over one billion zlotys by the end of 2013.

    Contract for the continuation of the repair work on the bridge "MA 532"

    On June 26, 2013 GDDKiA signed the contract with Intercor to continue the repair work imposed by the Silesian Voivodeship Inspector for Building Supervision on the "MA 532" bridge. The company was selected based on the cheapest offer in discussions with various companies. The work should initially be completed at the end of August 2013. On August 24, 2013 it was announced that the Silesian Voivodeship Inspector for Building Supervision had granted a postponement of the date requested by the GDDKiA after the inspection of the construction work carried out so far. The repair work was successfully completed on March 21, 2014. The cost was PLN 55 million.

    Third contract

    The start of a new tender was announced in mid-July 2013. Until the opening of the offers at the end of August, a single offer from Intercor had been received with construction costs of 50 million zlotys, which exceeded the amount of 27 million zlotys provided by the GDDKiA. On September 23, the only offer was selected as the best. The building contract was signed on October 4th. The construction work included a. the complete completion of the bridge "MA 532", the repair of the defects found during the construction work of the previous construction companies as well as the renewal of the road surface of all local roads damaged during the entire construction period. After seven months on May 23, 2014, the section was opened to traffic. After a total of seven years of construction and a four-year delay, this section was completed as the last section of the line from the Pyrzowice junction to the Czech border. Minor construction work outside the carriageway was completed by the end of July 2014.

    Łódź Północ - Pyrzowice

    This 180-kilometer section leads from the Łódź Północ junction via Tuszyn , Piotrków Trybunalski and Częstochowa to the Pyrzowice junction .

    1970s and 1980s

    In 1972 the planning for the course of the subsection from Tuszyn to Częstochowa was started. They stipulated that the new road should bypass all localities and be expanded like a motorway . The road cross-section should consist of two lanes, each with two lanes. The entire route was opened at the end of the 1980s. However, only the 17.5 km long route to Piotrków Trybunalski was designated as the A1 motorway. The rest of the route was signposted as Landesstraße 1 , as the originally planned nodes were realized as crossings with traffic lights .

    2000s

    At the beginning of the 2000s, the plans for the modernization of the existing line and the new construction of the remaining part of the section to Częstochowa were concretized. In 2005 the tender for the realization of the entire 180 km long route was started as part of a public-private partnership . The order consisted of the new construction of the Kn. Łódź Północ (former Kn. Stryków) - Kn. Tuszyn and Kn. Częstochowa Północ - Kn. Pyrzowice and the modernization of the existing section of the A1 Kn. Tuszyn - Kn. Piotrków Trybunalski-Południe and the existing section of the national road 1 kn. Piotrków Tryb. Południe - Kn. Częstochowa Północ together.

    On 22 January 2009, the contract was GDDKiA and the joint stock company Autostrada Południe SA, founded by the company Cintra (90%), Budimex (5.05%) and Ferrovial Agroman (4.95%) signed. As part of a concession , the company should be responsible for the planning, construction and operation of the line for 35 years. The route has been divided into three subsections. The construction of the subsections between the nodes Łódź Północ and Tuszyn (41 km) and between the nodes Tuszyn and Częstochowa Północ (82 km) should be completed by May 31, 2012. The completion of the subsection between the nodes Częstochowa Północ and Pyrzowice (57 km) as well as the completion of all construction work should take more than 60 months until January 2014. Due to the lack of a construction project, the construction costs were estimated at 7.5 billion zloty (approx. 1.7 billion euros ). On the other hand, the tolls after completion were set at 0.20 złoty / km for passenger cars and 0.46 złoty / km for trucks . The construction project should be completed by January 2010, the building permit received and preparatory construction work carried out. In addition, the financing should be secured with loans from various banks, including the European Investment Bank .

    This contract was automatically terminated on January 23, 2010 for financial reasons. Although there were many interested parties, including 30 commercial banks, the financing could not be fully secured. One of the reasons was the higher risk of failure compared to other concessions. The risk was related to the future tolls collected and thus also to the volume of traffic and was borne by the concessionaire. If the future tolls on this section of the motorway were lower than previously assumed, the concessionaire would suffer losses. Another reason was the tense situation among banks due to the financial crisis . The commercial banks called for loan repayments for the provision of the highway to be shortened from a 30-year contract period to a nine-year period. A corresponding proposal made by the concessionaire was rejected by the government. While the European Investment Bank and the European Bank for Reconstruction and Development issued loans totaling one billion euros and a further 600 million euros would have been added by shareholders, the commercial banks should have granted loans totaling 400 million euros.

    2010s

    After the failed realization within the framework of a public-private partnership , the construction project prepared by the former concessionaire Autostrada Południe was to be used first. After it was checked by the GDDKiA , the decision was made in March 2010 to discard the construction project and completely redesign it. This meant that it was no longer possible to complete this section for the 2012 European Football Championship . As a result, the 180 km long section was initially divided into two sections Łódź Północ - Tuszyn and Tuszyn - Pyrzowice , which were then further subdivided.

    Tuszyn - Pyrzowice

    This almost 140 km long section leads from the Tuszyn junction to the Pyrzowice junction and is between Częstochowa and Pyrzowice with two lanes, each with two lanes and the possibility of adding a third lane, between Tuszyn and Piotrków Tryb. Zachód and between Piotrków Tryb. Południe and Częstochowa with two lanes each with three lanes and between Piotrków Tryb. Zachód and Piotrków Tryb. Południe should be developed with two lanes each with four lanes. Both lanes are to be completely rebuilt and equipped with concrete ceilings . In addition, the node Piotrków Tryb. Zachód to be extended by the two missing connecting ramps. This section should also be subject to tolls for all vehicles.

    At the end of December 2011 it was announced that only the construction of this subsection was to be implemented as a PPP without any impact on the national debt. However, after Eurostat stipulated in new rules in March 2012 that all projects in the context of public-private partnerships in the EU countries are included in the national debt, the financing should be secured with the help of a new model. The new model envisaged that the construction of the motorway section should take place with the help of funds outside the state budget as part of a newly created Inwestycje Polskie program . Polskie Inwestycje Rozwojowe , a joint-stock company founded by the government, was planned as the investor . The state bank Gospodarstwa Krajowego , as operator, was to grant loans or guarantees to special purpose entities set up for the project, headed by private companies. With this model, increased tolls could have been introduced. At the beginning of 2014 it was announced that the route between Częstochowa and Pyrzowice will be the first to be realized by the GDDKiA as an investor, as the previous planning continued to have a risk of violating the permitted EU debt ratio. The remaining sections (Tuszyn – Częstochowa) should continue to be financed by a special purpose vehicle . In October 2016, this variant was finally rejected when the Ministry of Transport opted for direct financing from the National Road Fund ( Polish : Krajowy Fundusz Drogowy ). After clarification of all details on the financing between the Transport Ministry and the Ministry of Development, the necessary amendment was made to the Law on the National Road Program for 2014-2023 by the Government .

    At the beginning of 2011, the contracts for the renewed development of the construction project were signed. To this end, the section has been divided into nine subsections. The preparation of the new construction project did not take until April 2012, as stipulated in the contracts, but until January 2013.

    • Tuszyn knot - Piotrków Tryb knot. Poludnie (15.9 km)
      The tender for the optimization of the planning documents and the renovation or new construction of this subsection began on June 30, 2017 and ended with the signing of the contract between the GDDKiA and a consortium led by Budimex with Strabag as a partner on July 30, 2018. The planning - and the construction time is 32 months, the cost was set at 479 million złoty (120 million euros). As part of the construction work, the Piotrków Trybunalski Zachód junction will be expanded to include the missing connecting ramps. At the end of April 2019, the road cross-section was adjusted in a renegotiation of the contract. The construction work will include a third lane per lane on the section from Tuszyn to Piotrków Tryb. Zachód expanded, as originally only two lanes per lane were planned. The construction costs increased by around 50 million zloty (12 million euros). Since all structures and bridges have to be demolished and rebuilt, this led to a further renegotiation of the contract. With the additional work, the construction costs rose by 93 million zlotys (22 million euros) to a total of 622 million zlotys (156 million euros). Completion is still planned for the end of September 2021.
    • Piotrków Tryb node. Poludnie - Kamieńsk junction (15.2 miles)
      The tender for the optimization of the planning documents and the construction of this subsection began on June 30, 2017 and had to be canceled without result in November 2018 because the best offer selected by the GDDKiA from the Polish consortium consisting of the construction companies Mirbud and Kobylarnia shortly before the contract was signed in October was withdrawn and the remaining bidders refused to extend the binding period any further. The second tender started on December 18, 2018 and ended on April 14, 2019 with the signing of the contract between GDDKiA and the same Polish consortium. The construction costs are now 857 million zlotys (214 million euros). Completion is Template: future / in 2 yearsplanned for October 2022 after 35 months of planning and construction .
    • Kamieńsk junction - Radomsko junction (16.7 km)
      The tender for the optimization of the planning documents and the construction of this subsection began on June 30, 2017 and ended with the signing of the contract between GDDKiA and a consortium led by Strabag with Budimex as a partner on September 14, 2018. The construction costs amount to 573 million euros. Złoty (143 million euros), completion is planned for November 2021 after 32 months of planning and construction.
    • Radomsko junction - Łódź / Silesia border (7.0 km)
      The tender for the optimization of the planning documents and the construction of this subsection began on June 30, 2017 and ended with the signing of the contract between GDDKiA and the Polish company Intercor on August 30, 2018. The contract stipulated a 32-month planning and construction period as well as costs in the amount of 338 million zlotys (85 million euros). Completion is planned for October 2021.
    • Łódź / Silesia voivodeship border - Częstochowa Północ junction (17.9 km)
      For this subsection, the tender for the optimization of the planning documents and the construction of this subsection began on June 30, 2017 and ended with the signing of the contract between GDDKiA and the company Pol-Aqua on July 23, 2018. A 35-month planning and construction period and costs of 597 million złoty (149 million euros) were contractually agreed. Completion is planned for March 2022.
    • Czestochowa Północ junction - Czestochowa Blachownia junction (20.3 km)
      The tender for the optimization of the planning documents and for the new building began on March 5, 2014 and ended on October 12, 2015 with the signing of the contract between the GDDKiA and an Italian consortium led by Salini Impregilo . The construction costs should be around 703 million zlotys (approx. 176 million euros). A construction time of 33 months was agreed. At the beginning of the construction period, in addition to the first construction work, the planning documents were revised, including a. all planned toll booths were removed from the construction project. Completion was scheduled for April 2019. At the beginning of 2019, demands from the consortium for an increase in the contractually agreed costs became known, as price increases and the like since the contract was signed. a. came from building materials. Since a subsequent revaluation was not legally possible, the GDDKiA rejected these demands. After the consortium did not start construction work to the agreed extent after the winter break, the contract was terminated on April 29, 2019.
    • Czestochowa Blachownia junction - Czestochowa Południe junction (4.7 km)
      For this subsection, the tender to optimize the planning documents and the new building was started on March 5, 2014. The construction contract was signed on August 31, 2015 between GDDKiA and the Berger Group . The construction costs amounted to around 219 million zlotys (approx. 55 million euros). A construction time of 33 months was agreed, with completion scheduled for December 2018. In the first months of the construction period, in addition to the first construction work, the planning documents were revised, including a. all planned toll booths were removed from the construction project.
    • Czestochowa Południe junction - Woźniki junction (16.7 km)
      The tender for the new construction of this subsection, which began on March 5, 2014, ended on March 4, 2016 with the signing of the contract between GDDKiA and Strabag . The construction costs amounted to around 575 million zloty (approx. 144 million euros). A construction period of 30 months was agreed, with completion scheduled for June 2019. The signing of the contract was delayed by six months as the Central Anti-Corruption Bureau investigated investigations into suspected price fixing between companies for four different tenders. These investigations were discontinued due to insufficient evidence.
    • Woźniki junction - Pyrzowice junction (15.2 km)
      For this subsection, the tender for the new construction of this subsection was started on March 5, 2014. The construction contract for this subsection was signed on August 26, 2015 between GDDKiA and Strabag. The construction costs amounted to around 610 million zlotys (approx. 153 million euros). A construction period of 30 months was agreed, with completion scheduled for November 2018.
