The general municipal and district elections (municipal elections) in Bavaria 2014 took place on March 16, 2014, necessary runoff elections for mayor and district council elections were held on March 30, 2014, for example in Erlangen , Munich , Nuremberg , Regensburg and Würzburg . The date was set by the Bavarian State Government . In total, almost 40,000 elected officials were newly appointed in 25 independent cities and 71 rural districts with more than 2,000 municipalities.

Voting decisions

According to the administrative divisions of Bavaria the composition of the local assemblies of both the lower and the upper local level (thus the choosing municipal / city councils as well as the circuit days determined). In the 2031 district towns and municipalities with around 70 percent of Bavarian voters, this is done through separate voting processes. In the 25 independent Bavarian cities, both levels coincide, so only city councils are elected here. In total, more than 32,000 seats in city or municipal councils and around 4,400 district council seats were awarded on election day.

On March 16, voters in specific municipalities belonging municipalities also the mayor or mayor and the district administration in urban districts the mayor. Here the elections did not take place in all municipalities and districts because the term of office of mayors and district administrators does not always end at the same time as the general municipal elections. In six of the 25 independent cities ( Aschaffenburg , Bamberg , Bayreuth , Hof (Saale) , Landshut , Memmingen ), the mayors were not eligible for election that day, and there were no district elections in 13 of the 71 districts and mayor elections in 168 districts.

Innovations for the 2014 local elections

In February 2012, the Bavarian State Parliament passed some changes to the municipal and district electoral law, which first came into effect in the 2014 municipal elections:

  • Every EU citizen who had reached the age of 18 and had lived in the constituency for at least two (previously: three) months was entitled to vote .
  • The postal voting was significantly facilitated by was decided not to reason. Previously, in order to vote by postal vote, it had to be made credible that one would be prevented from voting on election day.
  • An important change was the elimination of the so-called “focus of life relationships”. Up until now it was only possible to vote for those who had had the focus of living in the constituency for at least six months. This clause was loosened, it was now possible to choose who has an apartment in the constituency for at least three months that does not have to be the main residence, or who - without having an apartment - usually stays in the constituency. In addition to German citizens , EU citizens could also be elected as municipal, city and district councilors , but not as mayors and district administrators.
  • Applicants could run as district administrator or mayor at the age of 18. So far, the age limit was 21.
  • The distribution of seats for the municipal decision-making bodies (city or municipal council, district council) took place for the first time in 2014 according to the Hare-Niemeyer proportional representation procedure . Previously, the D'Hondt maximum number method applied , which placed smaller parties and groups of voters at a disadvantage compared to larger ones .
  • It has also been introduced that an elected person can refuse or resign from office without giving a reason. The general obligation to assume honorary offices (Art. 19 of the Bavarian Municipal Code, Art. 13 of the Bavarian District Code) no longer applies to voluntary municipal elective offices in accordance with Art. 47, Paragraph 1, Clause 3 of the Municipal and District Election Act.

Independent cities and district assemblies

The CSU lost in most districts and urban districts, sometimes considerably, but was able to achieve significant gains of almost 5 percentage points in Munich . Nationwide, it lost a total of 0.3 percentage points and landed below 40% for the first time in decades. The SPD recorded losses of 1.9% and received 20.7%, its worst result since the establishment of the Free State of Bavaria. In 2008, free voters were still statistically recorded together with the other groups of voters; Taken together, these and the free voters achieved almost the same result as in 2008. The Greens gained two percentage points nationwide and achieved their best result in the Bavarian municipal elections with 10.2%; for the first time they won two district administrative posts ( Miesbach , Miltenberg ). Other parties only competed selectively and were therefore in the per mille range nationwide when added up. This affects the Bavarian party (0.6%), Die Linke (0.5%), the Republicans (0.4%), the AfD (0.3%) and the pirates (0.2%).

Elected mayors and district administrators

After the first ballot, 44 candidates won an absolute majority in 58 district council elections, while 14 candidates won an absolute majority in 19 mayoral elections. After the runoff elections in 14 rural districts and five independent cities on March 30, the final result was as follows:

For the district assembly Straubing-Bogen as well as the municipal council and mayoral elections in Geiselhöring, the election result was canceled by the government of Lower Bavaria . The background was that in Geiselhöring irregularities came to light during the counting: In a postal voting district, six list candidates of the CSU were elected to the top: A large asparagus farmer , four people from their environment and the mayoral candidate Herbert Lichtinger. 465 of 482 of the farmer's harvest helpers from other EU countries had voted by postal vote. After months of investigations by the Bavarian State Criminal Police Office , the police and the public prosecutor's office on suspicion of falsifying elections and documents as well as inciting false affidavits , they assume that over 350 of the votes cast are invalid. Lichtinger, who by his own admission was not involved in the manipulation himself, had won the mayoral election by only 303 votes. In the re-election, which took place on February 1, 2015, Lichtinger was able to improve his result significantly and was elected mayor with 61.5 percent.

The result of the district council election in the Fürth district was also canceled : In the run-up to the election, the mayors of Langenzenn and Großhabersdorf had called for candidates from their respective communities to be elected in their community newspapers. According to the government of Central Franconia , this violated the principle of neutrality applicable to mayors in their function.

In Grafenwöhr the result of the city council election was declared invalid by the district office due to electoral fraud . On October 4th, the Regensburg Administrative Court overturned the District Office's decision due to a formal error. The election result was confirmed by the administrative court judgment , so two city councilors of the Left also retained their mandates, although they had been convicted of electoral fraud in criminal proceedings that had meanwhile been concluded .

The city council election in Starnberg was canceled because the whereabouts of 8 ballot papers with a total of up to 240 votes could not be clarified and 40 votes would have been enough for a change in the distribution of seats. A new election took place on April 19, 2015.
