License plate liberalization

In Germany, the term license plate liberalization means a reform of the Vehicle Registration Ordinance (FZV). This means that districts and urban districts ( called administrative districts in the sense of the FZV ), which have been designated as legal successors of dissolved districts and urban districts, have the option of assigning several vehicle distinguishing marks when registering vehicles. These additional distinguishing signs (first one to three-digit letter combination on the license plates) result from the city and district abbreviations of the dissolved rural districts and urban districts that existed in the area of ​​today's administrative district. The ordinance reform through the first ordinance amending the vehicle registration ordinance and other road traffic regulations (FZVuaÄndV) came into force on November 1st, 2012.

From the introduction of the (West) German license plate system in 1956 (or from the introduction of the system in East Germany in 1991) to the territorial reforms of the 1960s and 1970s in West Germany (and from 1994 in East Germany), many vehicles had license plates derived from the city name ( " expiring “vehicle distinguishing marks ), which were no longer reassigned and which one wanted to use again in the future within the city concerned (and beyond).

The allocation of distinctive signs to independent cities and districts as the bearer of registration offices is regulated in the Vehicle Registration Ordinance. Until the amendment to the ordinance on November 1, 2012, all valid and expiring distinctive signs were listed in Annex 1 of this ordinance. The licensing districts that manage the old license plates were assigned to the expiring distinctive signs (e.g. "BOH" for Bocholt : Borken district ). As a rule, this approval district is the legal successor of the dissolved (Land) Kreis or the (Land) Kreis or the city in which the area of ​​the formerly independent city is located. As a result of the amendment to the ordinance described, Appendix 1 of the Vehicle Registration Ordinance was no longer applicable. Since then, the distinguishing signs are no longer specified in the regulation itself. The establishment and removal of distinguishing marks has instead been replaced by a simpler procedure. Until then, additions or changes to the valid or expiring distinctive signs listed in Appendix 1 required a formal change to the Vehicle Registration Ordinance, which required the approval of the Federal Council.

By means of a transitional provision in Section 50 (2a) of the Vehicle Registration Ordinance, the valid distinctive signs from the previous Annex 1 were defined as being valid when the change came into force, i.e. as of November 1, 2012, and those that are expiring as being repealed.

The new procedure stipulates that the Federal Ministry of Transport defines or removes the distinctive signs for the administrative districts at the request of the states after reviewing the application and publishes this in the Federal Gazette.

The reactivation of expiring abbreviations was made possible by the fact that, according to the new regulation, more than one distinguishing mark can be requested for an administrative district. The application options for the administrative districts that existed on November 1, 2012 were limited to the distinctive signs that were issued up to October 25, 2012. You can therefore only apply for previously expired abbreviations as additional distinguishing marks in addition to the existing ones.

For administrative districts that will emerge later, e.g. B. after territorial reforms, the restriction does not exist, so that new distinctive signs can be requested for these. The new regulation initially overlooked the fact that the restriction prevented the districts of Ludwigslust-Parchim and Mecklenburg Lake District in Mecklenburg-Western Pomerania from introducing new, uniform distinctive signs throughout the district. In these districts, which existed on November 1, 2012, the distinguishing signs of the predecessor districts were still issued at this point in time. At the initiative of the state of Mecklenburg-Western Pomerania, a further amendment to the vehicle registration ordinance specifically for these two cases included an exception in the transitional provisions in Section 50 (2a) of the ordinance, which made it possible to define the new distinctive signs "LUP" and "MSE".

The original aim of the license plate liberalization was to grant the legal successor of the dissolved regional authority the right to be able to reassign the distinctive signs noted as "expiring". The “License Liberalization Initiative” of the Heilbronn University under the direction of the Dean of the Tourism Management course , Ralf Bochert, played a major role in this reform . Between 2010 and 2012, students in this field carried out surveys on the reintroduction of old license plates in over 200 former district towns and in municipalities that lost their license plates as a result of district mergers, and received an average approval rating of over 74%. Some of the East German federal states in particular pleaded for this, inspired by the initiative of the Heilbronn University of Applied Sciences, since in the course of area reforms and district amalgamations a particularly large number of former place abbreviations that were listed as "expiring" have been dropped.

Legislative process

On the initiative of the Saxon State Ministry for Economic Affairs, Labor and Transport , the Conference of Transport Ministers of the Länder recommended in April 2011 that the reintroduction of expiring license plates should be made possible by amending the Vehicle Registration Ordinance. At the beginning of 2012, a technical committee at the Federal Ministry of Transport presented the Federal Council with a draft amendment to the vehicle registration regulation with the aim of reintroducing the old license plates. In August 2012, Federal Transport Minister Peter Ramsauer announced that, according to the draft regulation, it would be possible to introduce completely new distinctive signs in addition to the reintroduction of old license plates. After the Transport Committee of the Federal Council had approved the change to the FZV on September 5, 2012, the Federal Council approved in its 900th meeting on September 21, 2012 the plans of the Federal Government to re-permit the old vehicle number plates, but at the same time granted the creation of previously unused ones Distinguishing sign a rejection. This was justified by the fact that the submitted draft went well beyond the re-approval of expiring distinctive signs demanded by the Conference of Transport Ministers. The corresponding ordinance (FZVuaÄndV) was announced in the Federal Law Gazette on October 25, 2012 and came into force on November 1, 2012.

Reactions

Federation

The Federal Minister of Transport was positive about the liberalization of license plates and ensured that the regulation was implemented quickly. The first "old license plates" could already be issued on November 9, 2012. In addition to the reintroduction of old license plates, his draft ordinance also provided for the extensive approval of the introduction of completely new distinctive signs, which was ultimately rejected by the Federal Council.

Federal states

On the part of the federal states, there was almost unanimous agreement in favor of the initiative after some federal states had initially reacted hesitantly or negatively. Almost all states except Brandenburg wanted to approve the expected Federal Council proposal. In Rhineland-Palatinate , the responsible minister did not stand in the way of the wishes of the old district towns. The Saxon Ministry of Transport had also announced that it would reintroduce all expiring letter abbreviations if this was possible under federal law. The responsible ministries in Bavaria and Baden-Württemberg also agreed to the regulation. Meetings were held in the ministries and inquiries were made to the responsible municipalities and cities. In Hesse , Lower Saxony and Schleswig-Holstein , the state sought that the cities and districts concerned should come to an agreement. However, the decision was usually made by a district committee or the city council of the respective independent city. The Thuringian Ministry of Transport announced early on that it wanted to apply to the federal government for the reintroduction of 20 of the 21 license plates that have expired since 1995. The Ministry of Economics, Energy, Building, Housing and Transport of the State of North Rhine-Westphalia has asked the districts and independent cities to coordinate with the cities and to find a political decision on reintroduction.

(Land) districts

The mood in the districts was mixed. Several district days in the federal states have spoken out against reintroduction in order not to question the area reforms and to strengthen or maintain the sense of community in the districts. The district assembly of North Rhine-Westphalia rejects the reform as “a further fragmentation of the license plate landscape”, which also “brings with it considerable disadvantages for the prevention and fight against crime”. The North Rhine-Westphalian Ministry of the Interior rejected the concerns: Nothing changes in the determination of the vehicle owner - everything else is "a matter of getting used to". The districts in Hesse, Bavaria and North Rhine-Westphalia showed a very differentiated picture on the subject. Some circles in their political bodies agreed to the reintroduction, while others opposed it. In addition to the above-mentioned reasons, administrative risks were also cited (high costs and administrative chaos), while other circles considered the costs and administrative effort to be low or non-existent.

Still other districts such as the districts of Roth , Wetteraukreis , Göttingen and Northeim did not close themselves to liberalization and advocated the reintroduction of the old license plates at an early stage.

Cities and districts

The initiative met with a largely positive response from the cities concerned (former district towns, former urban districts and district towns in merged districts). Many of the municipalities expect the reintroduction to improve their image and hope to increase their national awareness and the associated improved opportunities in the field of tourism and business settlement. In addition, a positive internal marketing impulse is expected because the great approval of the population of the cities symbolized by the identifiers suggests that the identifiers would improve identification with the respective city. The topic was on the agenda in many city and community councils and local councils and was mainly supported.

In some federal states, several cities have drawn up joint declarations in which they advocated the reintroduction of the old license plates and the respective state was requested to take the necessary legal steps at federal level. In the federal states of Lower Saxony, Hesse and North Rhine-Westphalia, cities also approached their district administrations directly to promote the issue. In the Ruhr area in particular, there is a situation in which former urban districts have been incorporated into other districts and urban districts (e.g. Wattenscheid or Wanne-Eickel ). Here, too, the city or district population and the responsible city councils or local advisory councils spoke out in favor of reintroducing the former license plate abbreviations.

Citizens' initiatives

In the district of Minden-Lübbecke ( MI ), the district council based in Minden opposed liberalization. The point was that the vehicle owners of the former Lübbecke district received the LK distinctive sign , which was abolished in 1973 with the district reform (Section 21 Bielefeld Law ) . Since district councils from the clearly more populous old district of Minden have a majority in the district council, this request could be blocked. Since in the old district of Lübbecke, especially in the old district town of Lübbecke , there was a clear majority in favor of the reintroduction of the LK label, the citizens' initiative Pro LK- Kennzeichen was able to establish itself here . A large-scale signature campaign was announced for the beginning of 2013. At the end of February 2013, the initiative of the Free Voters' Association WL joined.

From a legal point of view, a district council vote is not necessary in this matter, as the registration of motor vehicles and trailers is a task assigned to the district office / district administration by the state, over which the district's parliament, the district council, has no influence. Nevertheless, some state ministries have advised that the decision on reintroduction should be made through a democratic resolution. This was the case in North Rhine-Westphalia and also in Baden-Württemberg. Since it was determined that only the districts can apply for the respective old abbreviations, protests and signature campaigns took place in some old district towns, as described in the Lübbecke case. This was particularly evident in the Lake Constance region with the old districts of Stockach ( STO ), Tettnang ( TT ) and Überlingen ( ÜB ), in whose cases there was a negative vote in the respective district council. In Baden-Württemberg, a "nationwide" online petition was finally launched under the title Yes, every eligible Baden-Württemberg city should receive its retro license plate if it wants to, which ran until mid-May 2013.

Special regulations and plans before the reform comes into force

Since 2005 applies in the formerly independent city Hanau as a special city for special treatment in Hesse since June 1, 2005 Hanau used the flag HU , while the rest of Main-Kinzig district since 2005 because of the change of the administrative headquarters from Hanau to Gelnhausen the newly introduced distinctive signs MKK leads.

In December 2011, the Federal Council decided to include the distinctive symbol WZ , which was being phased out, in the list of assignable license plate abbreviations, as the city of Wetzlar, as a special status city, was to become the seat of a municipal registration office, analogous to Hanau. Since July 1, 2012, "WZ" has been issued again.

In Mecklenburg-Western Pomerania , the district reform carried out in 2011 created large administrative units that have yet to grow together. In some of these districts, the previously used distinctive signs remained valid for the time being, other districts have been assigned new abbreviations. The former independent cities of Greifswald , Neubrandenburg , Stralsund and Wismar as well as the former district of Rügen kept their location identifiers in the newly formed districts. At the registration office in Bergen auf Rügen , citizens were able to choose between the old abbreviation RÜG and the new VR for the new district of Western Pomerania-Rügen before the license plate liberalization came into force .

Although it was never a district seat or a district and therefore had no distinctive sign of its own, the Hessian city of Rüsselsheim am Main is also striving for a regulation similar to that of Wetzlar within the district of Groß-Gerau , so that all Hessian special status cities would then have a label derived from their name. So far, Rüsselsheim's wish has not been fulfilled.

Implementation of the reform

Immediately after the reform came into force, the states of Saxony, Lower Saxony, Rhineland-Palatinate, Thuringia and Schleswig-Holstein submitted applications for the reintroduction of one or more distinctive signs to the responsible federal ministry, which approved the reintroduction of 71 distinctive signs by mid-November 2012.

The following number of distinguishing marks were permitted:

  • 45 in Saxony
  • 11 in North Rhine-Westphalia
  • 08 in Lower Saxony
  • 06 in Rhineland-Palatinate
  • 01 in Schleswig-Holstein
  • Saxony was the first federal state to allow the use of the 45 previously expiring distinctive signs from November 9, 2012.
  • In North Rhine-Westphalia , the first license plates that had already been canceled were issued again from November 13, 2012.
  • Lower Saxony followed with ten distinctive signs from November 15th.
  • In Schleswig-Holstein initially only the distinguishing sign of the old district of Eckernförde ( ECK ) was applied for, approved and reintroduced.
  • In Saxony-Anhalt , all old license plates were reintroduced.
  • In Thuringia there were 20 old license plates (all except ESA ) by the end of November 2012.
  • The state of Brandenburg has applied for the reintroduction of 12 previous license plates for 5 of 14 districts, namely CA, FI, FOR, FRW, GUB, KY, NP, SEE, SFB, SPB, SRB and WK .
  • Baden-Württemberg has applied to the federal government for the re-registration of five old license plates, whereby one had to agree with the state of Saxony-Anhalt for the abbreviation BK for Backnang, as it has been used by the Bördekreis since 2008. An agreement could be reached here, so that this distinguishing mark is issued in two different federal states (differentiation by number groups). The four other distinctive signs BCH, GD, HCH and LEO have been issued again in the respective districts since February 25, 2013. The MGH label has been issued again since January 7, 2014.
  • In Mecklenburg-Western Pomerania, at the request of the Minister of Transport, the reintroduction of all distinctive signs of dissolved rural districts was approved. As a special feature, the individual districts were allowed to decide whether they wanted to make use of the option of issuing the reintroduced old license plates. In the first districts, the issue began on March 14, 2013. Since August 1, 2013, with the exception of OVP and UER in the district of Vorpommern-Greifswald, all distinctive signs of dissolved districts have been reissued.
  • In the Free State of Bavaria, the cabinet decided in January 2013 the requirements for the reintroduction, according to which the approval of the affected district or the affected urban district is required for the respective approval body. The reallocation began in the first districts that had spoken out in favor of the reintroduction on July 10, 2013. A special feature is that several old distinctive signs reintroduced in Bavaria are issued by several districts or licensing authorities.
  • The distinctive signs BH in Baden-Württemberg and LH , MON and SLE in North Rhine-Westphalia are now being issued again in two administrative districts. There is a special feature of the latter distinctive signs: You can no longer determine the issuing approval body with the help of the identification number. Only the respective legal successors of the dissolved districts assign the license plate combinations.
