District reform of Saxony 1994/1996

The district reform carried out in Saxony in 1994 and 1996 was decided on June 24, 1993 by the Saxon state parliament . The 48 districts and six independent cities in Saxony formed in 1952 were dissolved and 22 new districts and seven independent cities were formed. This administrative structure existed until August 1, 2008, when the Saxony district reform came into force in 2008 .

In April 1991 the state government decided to carry out a district reform in Saxony. The aim for the districts to be formed was a minimum size of 125,000 inhabitants.

A first bill was introduced into the legislative process by the state government on June 29, 1992. This was preceded by hearings with the districts and associations concerned. It provided for the formation of six independent cities and 23 districts. As part of the legislative process, the layout of the districts was changed several times. In many cases the end result deviated from the original design.

Some districts subsequently brought an action against the law before the Saxon Constitutional Court. The lawsuits concerned the dissolution of the Dresden-Land district and the formation of the Meißen-Dresden and Saxon Switzerland districts, the dissolution of the Hoyerswerda and Kamenz districts and the formation of the independent city of Hoyerswerda and the Westlausitzkreis, and the dissolution of the Plauen districts , Oelsnitz, Reichenbach, Auerbach and Klingenthal and the formation of an Elstertalkkreis and a Göltzschtalkkreis and around the seat of the district offices of the district of Leipziger Land and the Lower Silesian Oberlausitzkreis. In June / July 1994 the relevant court rulings were pronounced. Since the court complained that there were in particular deficiencies in the hearing / participation of the plaintiff districts in the legislative process, the law was partially declared null and void. The state government was thus forced to improve the district reform through three amendment laws.
