List of important election dates and terms in Germany

This list contains all election dates for the elections to the European Parliament , the German Bundestag , all state and local elections in the Federal Republic of Germany since 1945, as well as the expected dates of the next elections.

The list is supplemented by information about the respective electoral term (short: WP), the first session and the last session of a parliament or other body, the number of meetings and the number of members (mandates) per electoral term.

General

Legislative period versus electoral period

Compared to the term of the legislative period , the term of the electoral term is wider. While the legislative period describes the term of office of a parliament, the term electoral period also includes the periods when other representations or bodies such as B. a municipal council or a works council .

Election date versus term

A strict distinction must be made between the date of the election and the start of an election or legislative period. The legislative period is the period in which an elected parliament enacts laws (Latin "lex", plural "leges"). As a rule, the electoral period does not begin until after an election, not on the election day itself, on the day of the first, so-called constituent meeting . It usually ends with the meeting of a new parliament or body. However, special features apply depending on the country or body.

Practical significance of the electoral term

In addition to the primarily parliamentary documentation, the electoral term is of practical importance, for example for the coming into force of certain legal provisions. This can be regulated depending on the beginning of an electoral term.

For example, Article 7 of the law amending the Lower Saxony state electoral law, the Lower Saxony parliamentary law and the ministerial law of December 16, 2004 (Nds. GVBl. P. 626) reads as follows:

In force
(1) Article 1 on the day after its promulgation.
(2) Articles 2, 4, 5 and 6 shall enter into force on 1 January 2005.
(3) Article 3 shall enter into force at the beginning of the 16th electoral term .

Articles 2 and 3 of this Cover / Article Act change the Nds. Deputies Act: Article 2 as of January 1, 2005, Article 3, however, only at the beginning of the 16th electoral term of the Nds Landtag, i.e. February 26, 2008.

European Union

The dates of the European elections are listed , provided that the German MEPs are elected according to the European Election Act.

Federal Republic of Germany

Since 1976 the parliamentary term of the Bundestag begins with the first, namely constituent meeting of the newly elected parliament. The new Bundestag is convened by the previous Bundestag President. According to Article 39.1 sentence 2 of the Basic Law, the electoral period ends with the first meeting of the next Bundestag. So there is no so-called no parliamentary period.
