Small regions of Styria

Kleinregionen (KR) are voluntary collaborations between municipalities in the federal state of Styria in the areas of services of general interest , citizen service and municipal and regional spatial development . 88 small regions were founded, of which only 36 were described as actually established (constituted) in 2014.

In total, there were efforts to found over 100 small regions (see table below). The experiences with the small regions flowed into the Styrian municipal structural reform . As a result of this, with effect from January 1, 2015, many participating communities from the former small regions were united to form larger communities. Although many municipalities had joined together to form small regions, the desired effects of this measure fell far short of expectations.

Basics, tasks and goals of the small regions

As early as the early 1970s, the Styrian People's Party developed a reform model for the structures of regional policy (Styria model) . This was taken up again in spring 2007 as the model: Future: Styria ("Schützenhofer model", after the LH deputy and party chairman Hermann Schützenhöfer ). It was then laid down in the Regionext concept by the Styrian state government.

The legal basis of small regions is the Styrian Municipal Code 1967 (GemO), in the version of the 2008 amendment and the 2014 amendment, with which simplifications and adjustments to the municipal structural reform were made.

"Municipalities that are spatially and functionally connected to one another can join together to form small regions to coordinate their development and to plan efficient joint management of municipal tasks."

Since 2015, a small region must consist of at least two municipalities, the previously approved small regions remain as long as this condition is met (Section 106c GemO). Until the end of 2014, the condition for the constitution of a small region was a minimum number of four participating municipalities or a total number of the resident population of at least 3000 people (Section 38a (1) GemO). Some of the regions emerged from small regions in the sense of Local Agenda 21 , the UN Sustainability Program, from 1992, or EU structural support measures after Austria joined the EU in 1995.

The first small region within the meaning of the municipal code was formed in April 2009 with the small region Straden in southeast Styria.

Small regions represent a form of the community association (§ 38a Abs. 3 GemO). Organs are the small-region assembly , which consists of all municipal council members of the participating municipalities, the small-region executive committee, which consists of all mayors, and the association chairman , who is elected from among them (§ 38a Paragraph 4 ff GemO).

The small regions are financed by the European Regional Development Fund  (ERDF) and funds from the State of Styria, Dept. A16 State and Community Development .

Small-  regional development concepts (KEK) are to be drawn up within the associations , which form the basis of community cooperation and small-regional development planning. The contents of this KEK are:

  • an analysis of the current situation (description of the initial structural situation of the small region, cooperation profile, infrastructure profile, financial analysis, overview of existing community cooperation)
  • a strengths / weaknesses-opportunities / threats (SWOT) analysis
  • the definition of a common strategic direction and objectives
  • the definition of common municipal tasks

The Reitingblick small region in Obersteimark created the first development concept in June 2011.

Results, experiences and effects of the introduction of small regions

The advantage of the small regions was that they offered the municipalities (in addition to the already existing possibility of setting up companies, e.g. GmbH, or associations according to the relevant legal provisions) an additional opportunity for cooperation. However, these possibilities were not used to the expected extent - the disadvantage of the small regions turned out to be that the participating municipalities remained independent, so that the municipal councils of all participating municipalities had to be involved in all changes and their interests had to be influenced took the planned projects or were able to prevent them. It was reported in the state parliament, for example, that even after a ten-year attempt it had not been possible to get a project on its feet because there had always been a different mayor, office manager, etc. This situation was paraphrased with the words "... in reality this leads to small successes to no successes."

The small regions and the experiences that were made with them formed an important basis for the amalgamation of municipalities within the framework of the municipal structural reform of Styria 2010–2015 .

In the small region of Reitingblick , the first municipal merger on the basis of the Regionext program took place on January 1st, 2013 ( Hafning and Gai with Trofaiach ).

In the explanations of the government bill for the Styrian Municipal Structural Reform Act, which were drawn up by the Styrian regional government , the experiences with the small regions were summarized as follows. These explanations were part of the documents on which the resolution on the municipal structural reform in the Styrian Landtag was based:

“In contributions to the debate, the Styrian Landtag has dealt several times with the question of whether voluntary community cooperations or community associations are just as suitable for achieving the goals pursued by community reform. But that would only be the case if the same administrative and / or economic advantages described can be achieved with the voluntary community cooperation or community associations . The state parliament has examined whether the reform goals can also be achieved in one or more municipal associations. In general, the following considerations speak against an association solution:

  • Firstly, municipal agreements “in the case of sovereign administration matters must not jeopardize the function of the municipalities involved as self-governing bodies” (Art 116a, Paragraph 1, Item 1 B-VG ). The B-VG thus forbids a “too concentrated” community cooperation, the communities must remain self-governing bodies . This already sets limits to a structure comparable to a community union.
  • Second, the financial performance can be strengthened through community cooperation, but the sustainability of this strengthening is not guaranteed. In particular, the communities that have joined a community association can leave it again. A “termination” of a legally effective community association is not possible. Only the community association enables a sustainable and reliable strengthening of the community performance.
  • Thirdly, municipalities can form different forms of cooperation with other bodies in different matters. As a result, a heterogeneous "cooperation network" that is differentiated according to issues can develop, which can make central spatial planning particularly difficult. An unstructuredly developed cooperation network can also have detrimental effects from the point of view of effective community supervision.
  • Fourth, an association solution increases the general work and administrative effort, as an additional administrative level is created above the municipalities. This means that the expectations of a functioning, cost-effective administration cannot be met in many areas.
In view of this, it can be assumed that the possibility of forming multi-purpose associations created by the B-VG amendment in 2011 cannot replace the comprehensive structural reform of the municipalities through area changes, but only represents a supplementary model. "

In a statement in the proceedings before the Constitutional Court against amalgamation of municipalities in the context of municipal structural reform, the Styrian. State government also pointed to a legal study from 2012, which came to a similar conclusion. This was reflected in the decision of the VfGH with the quote:

"An overall legal and political assessment of cross-community forms of organization is therefore in favor of mergers and regional communities, because these can be designed more efficiently and financially and - as I said - allow the loss of community identity to be mitigated."

List of the small regions in Styria

Since 2015, as part of the municipal structural reform, some municipalities appear in several small regions because they have accepted former municipalities from several small regions (e.g. Deutschlandsberg , Gnas ). Furthermore, there are small regions that will only consist of one municipality from 2015 and therefore no longer comply with the rules for small regions (e.g. Stainz ), and the area of ​​some small regions has also been merged through the amalgamation of municipalities (if only part of the new municipality is a the small region was) changed (e.g. Schwarzautal ). From 2015, further changes or the end of some small regions in their previous form (which form part of the administrative organization of the State of Styria and should not only establish regional tourism associations) can be expected.
